NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT IMPROVE CHANCES OF WINNING. THE FOLLOWING CAMPAIGN IS OPEN ONLY TO PERSONS WHO MEET THE CRITERIA (AS DEFINED IN THE RULES BELOW). ALL FEDERAL, STATE, PROVINCIAL, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHEREVER PROHIBITED. CAMPAIGN NAME: The Tricked Out for Treats Pet-Tacular Campaign (the “Campaign”). The Campaign consists of (i) a pet photo contest (the “Photo Contest”) and (ii) a sweepstakes for a prize bundle (the “Sweepstakes”).

SPONSOR: The Campaign is sponsored by Trupanion Managers USA, Inc., an affiliate of Trupanion, 6100 Fourth Avenue South, Suite 200, Seattle, WA 98108 (“Trupanion” or “Sponsor”).

DATES/CAMPAIGN PERIOD:

Photo Contest: The entry period runs from 9:00 AM (PT) on October 1, 2024 to 5:00 PM (PT) on October 29, 2024 (“Photo Entry Period”). Entries for the “Adorably Adoptable” category must be entered before 5PM (PT) On October 21, 2024. Only Photo Entries (defined below) submitted during the Photo Entry Period will be eligible to enter the Photo Contest. Public voting on the Photo Contest Categories (defined below) will take place from approximately 1:00 PM (PT) on October 1, 2024 to 5:00 PM (PT) on October 29, 2024 (“Voting Period”). Voting for the “Adorably Adoptable” category will take place from approximately 1:00PM (PT) On October 1, 2024 to 5:00PM (PT) on October 21, 2024. Final judging will take place for the “Adorably Adoptable” category on October 22, 2024. Final judging will take place for all other categories on October 29, 2024. One winner per Photo Contest Category (“Photo Winners”) will be announced on October 30, 2024 on the Tricked Out for Treats platform located at trickedout.trupanion.com at 12:00 PM (PT) (the “Event”).

Sweepstakes: The entry period runs from October 30, 2024 at 12:00PM (PT) to October 30, 2024 at 5:00PM PT (the “Sweepstakes Entry Period”). One (1) winner from the United States and one (1) winner from Canada will be selected at random by Sponsor following the Sweepstakes Entry Period on October 30, 2024. Winners will be notified no later than November 4, 2024.

ELIGIBILITY: Entrants for both the Photo Contest and Sweepstakes must meet the following criteria (“Criteria”): (i) are legal residents of Canada (excluding Quebec) or the 50 United States (including the District of Columbia and Puerto Rico but excluding North Dakota and West Virginia) (ii) 18 years or older or the age of majority in place of residence at the time of entry, whichever is greater, and (iii) have the legal right to enter the Campaign. All federal, state, provincial, municipal and local laws and regulations apply.

In addition, each Photo Winner must, upon request, (i) submit a publicity release in a form provided by Sponsor providing Sponsor broad rights to copy, display, edit, and distribute such Photo Winner’s Photo Entry and/or elements thereof on social media, on Trupanion’s website, and by any other means now known or hereinafter developed (except where prohibited by law), and consent to these Official Rules by October 30, 2024. In the event that a Photo Entry from a Photo Winner is deemed to be in violation of these Official Rules, or if the Photo Winner is unable or unwilling to provide any documentation described above, Sponsor may, in its sole discretion, disqualify such Photo Entry and select an alternate Photo Winner in accordance with the terms below.

No social media company, including, without limitation, Facebook, Instagram, LinkedIn, X and/or Google+ are in any way associated with this Campaign. Employees, officers, or directors of Sponsor and its affiliates and their respective administrative, advertising, and promotion agencies, and any other entity involved in the development, administration, promotion, or implementation of the Campaign and their immediate family members (spouse, parents, siblings and children) are ineligible to enter the Photo Contest or Sweepstakes.

HOW TO ENTER:

Photo Contest: Entries must be received during the Photo Entry Period. To enter the Photo Contest, entrants must complete the entry form on www.trickedout.trupanion.com and include (i) a pet photo, (ii) a written narrative describing the pet (the “Narrative”), and (iii) any other information reasonably requested, including contact information for the entrant (each, a “Photo Entry”). No other forms of entry are permitted.

Sweepstakes: Entries must be received during the Sweepstakes Entry Period. To enter the Sweepstakes, entrants must (A) complete the entry form on https://trickedout.trupanion.com/vote and include (i) contact information (including name, email address, and postal/ZIP code) and (ii) any other information reasonably requested or (B) send name, email address, and postal/ZIP code to sayhello@trupanion.com (each a “Sweepstakes Entry” and together with a Photo Entry, an “Entry”). No other forms of entry are permitted. Limit one Sweepstakes Entry per person.

Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of these Official Rules are void. All Entries are reviewed by Sponsor for eligibility.

Entrants to the Photo Contest and Sweepstakes grant Sponsor a perpetual, transferable, sublicenseable, non-exclusive, worldwide license to (a) use, copy, transmit, distribute, reproduce, modify, create derivative works from, adapt, combine with other ideas or works, publish, translate, publicly perform, publicly broadcast and publicly display the Entry (except where prohibited), or any modification thereto, in whole or in part, in any format or medium now known or later developed without attribution, and (b) use (and permit others to use) the Entry (except where prohibited) in any manner and for any purpose, including without limitation: marketing, advertising, commercial or promotional purposes that Sponsor or its agents deem appropriate without any further compensation or review, except where prohibited.

Entrants to the Photo Contest and Sweepstakes agrees that such entrant is solely responsible for the Entry. Sponsor is not required to host, display, or distribute the Entry on or through its websites, on social media or otherwise, and may remove an Entry at any time or refuse an Entry for any reason. Sponsor is not responsible for any loss, theft, misuse or damage of any kind to an Entry.

Entrants to the Photo Contest and Sweepstakes hereby represent and warrant that:

  • such entrant owns all rights in and to the Entry including without limitation, all rights to the audio, video and or digital recording and performance contained in an Entry (if any), and/or such entrant has acquired all necessary rights to the elements appearing in an Entry to enable entrant to grant all the rights to Sponsor as described herein.
  • the Entry is wholly original and does not infringe on the copyright, trademark, patent, trade secret or any other intellectual property rights, privacy rights, or any other legal or moral rights of any third party individual or entity.
  • such entrant agrees to release and allow all creative license and creative treatment in the use and production of an Entry at the discretion of Sponsor and its agents.
  • such entrant will not be compensated or granted any consideration in any way for the use of an Entry.
  • • such entrant irrevocably releases and forever discharges the Sponsor, its parent companies, affiliates, subsidiaries, divisions, and advertising and promotion agencies, and their respective officers, directors, shareholders, and employees from any and all actions, claims, damages, liabilities and demands, whether absolute or contingent and of any nature whatsoever, which such entrant now has or hereafter may have against any of the foregoing, or their respective successors or assigns, arising out of or related in any way to Sponsor’s use of an Entry or anything contained therein.

Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an Entry.

CONTENT GUIDELINES AND RESTRICTIONS:

PRIZES: Prizes are not transferable or redeemable for cash, except in the sole discretion of Sponsor. All prize details including without limitation style, color, and selection are at Sponsor’s sole discretion. Incidental expenses and all other costs and expenses which are not specifically listed as part of the prize in these Official Rules and which may be associated with the award, acceptance, receipt, and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. All federal, state, and local taxes associated with the receipt or use of any prize are solely the responsibility of the winner. Any person winning $600 or more worth of prizes from Sponsor in a calendar year will receive an IRS form 1099, and copy of such form will be filed with the Internal Revenue Service.

PUBLICITY & ENTRANT INFORMATION: By participating in the Campaign, each entrant consents to the use of their Entry and information contained therein, including, without limitation, name, address, email address, postal code, telephone number, social media handle(s), comments and image, whether on videotape, photograph or any other means, in each case for the administration of the Campaign or any publicity carried out by the Sponsor, without further notice or compensation, except where prohibited by law. Entrants understand and agree that entrant’s name and Entry content (“Content”) will be publicly displayed, and that it will not be treated in confidence and entrants hereby provide Sponsor and its affiliates with the unlimited, worldwide right to use and share entrant’s name (except where prohibited) and Content (i) on its websites; (ii) in all of its social media channels, such as Facebook, X, Instagram and Pinterest, including in both organic posts and paid ads; (iii) digital ads; and (iv) other promotional materials of any kind or type, including print materials.

RULE AMENDMENTS: The Sponsor reserves the right, in its sole discretion, to amend or modify these Official Rules, or modify, cancel or suspend this Campaign in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Campaign. Any changes will be posted on www.trickedout.trupanion.com/terms-and-conditions and will be effective upon posting unless another effective date is specified. Without limiting the foregoing, if, for any reason, the Campaign is not capable of running as originally planned for any reason, the Sponsor reserves the right to end the Campaign and submit outstanding Entries for judging in accordance with these Official Rules.

PRIVACY AND THIRD-PARTY TERMS: By participating in the Campaign, entrants and Voters acknowledge that they have reviewed and agree to Sponsor’s Privacy Policy provided at https://trupanion.com/about/privacy-policy-main (the “Privacy Policy”). Unless otherwise specified in these Official Rules and as specified above, information submitted with an Entry will be used and disclosed in accordance with the Privacy Policy. Entrants and Voters also acknowledge that Sponsor is not responsible for the privacy policies of X, Instagram, or Facebook, LinkedIn, or any other third-party website to which Sponsor may link, and entrants and Voters should review the relevant policies to understand the information that is shared by the social media sites or other third-party website.

LAW: This Campaign shall be governed exclusively by the laws of the state of Washington, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in King County, Washington.

WAIVERS AND RELEASES: By entering and/or voting, each Entrant and Voter agrees: (a) to be bound by these Official Rules and the decisions of Sponsor, which are final and binding; (b) to waive any right to claim ambiguity in the Campaign or these Official Rules; (c) that they may be contacted in person, by phone, social media, or by e-mail, with respect to the Campaign; (d) that Sponsor and its parent companies, affiliates, subsidiaries, divisions, and advertising and promotion agencies, and their respective officers, directors, stockholders, and employees (collectively “Releasees”) are not responsible for lost, damaged, or misplaced entries, incorrect or inaccurate transcription of Entry information, or for any human or other error, technical malfunction, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or web site, or any other error or malfunction, or any injury or damage to entrant’s or any other person's computer related to or resulting from participation in this Campaign, or for any injury to person or property; and (e) that the Releasees will not be liable for losses or injuries of any kind resulting from acceptance/possession/use and/or misuse of the prizes, travel to and from any prize-related activity, participation in the Campaign, or printing, mailing or distribution errors. EACH ENTRANT AND VOTER ALSO IRREVOCABLY RELEASES AND FOREVER DISCHARGES THE RELEASEES FROM ANY AND ALL ACTIONS, CLAIMS, DAMAGES, LIABILITIES AND DEMANDS, WHETHER ABSOLUTE OR CONTINGENT AND OF ANY NATURE WHATSOEVER, WHICH THEY NOW HAVE OR HEREAFTER MAY HAVE AGAINST ANY OF THE RELEASEES, OR THEIR RESPECTIVE SUCCESSORS OR ASSIGNS, ARISING OUT OF OR RELATED IN ANY WAY TO TRUPANION’S USE OF SUCH PARTICIPANT’S NAME, CONTENT OR ANYTHING CONTAINED THEREIN. EACH WINNER FURTHER ACKNOWLEDGES THAT SPONSOR DOES NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, RELATING TO THE PRIZES THEMSELVES AND THAT SPONSOR EXPRESSLY DISCLAIMS THE IMPLIED WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE.

LIMITATION OF LIABILITY: EACH ENTRANT AND VOTER AGREES TO RELEASE, HOLD HARMLESS, AND INDEMNIFY EACH OF THE RELEASEES FROM AND AGAINST ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE ACCEPTANCE, USE, MISUSE, OR AWARDING OF A PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO OR FROM ANY PRIZE OR CAMPAIGN-RELATED ACTIVITY INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, LOSS, DEATH OR ACCIDENT TO OR OF PERSON OR PROPERTY. EACH WINNER AGREES THAT THE PRIZES ARE PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

EACH ENTRANT AND VOTER UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:

“CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”

SEVERABILITY: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

Limit one (1) request per outer envelope. Rules requests must be received during before October 29, 2024, or October 21, 2024 for the “Adorably Adoptable” category.

WINNER’S LIST: Winners’ names will be available upon conclusion of the Campaign at www.trickedout.trupanion.com and on Trupanion’s Facebook, X, and Instagram pages. Names of the winners may be requested for up to eight weeks following the announcement of the winners by sending a stamped, self-addressed envelope to: “Trupanion ATTN: Tricked Out for Treats – Winner’s Listing,” c/o Trupanion Managers USA, Inc., 6100 Fourth Avenue South, Suite 200, Seattle, WA 98108. Limit one (1) request per outer envelope.

OTHER CONDITIONS: By entering and/ or voting in the Photo Contest and/or Sweepstakes, each entrant agrees to all the terms and conditions in these rules (“Terms and Conditions”). All federal, provincial, state and local taxes on prize and all expenses related to acceptance and use of prize, not otherwise specified, are the sole responsibility of winner.

PHOTO CONTEST

PUBLIC VOTING & WINNER CRITERIA: One (1) Photo Entry for each Photo Contest Category (the “Photo Winners”) will be selected as winners from among the Photo Entries that meet the eligibility requirements set forth above and are received during the Photo Entry Period.

Public Voting Period: On or about October 1, 2024 by 1:00 PM (PT), Photo Entries that meet the eligibility requirements set forth above will be posted on www.trickedout.trupanion.com/vote (the “Showcase”) for public voting until October 29, 2024 at 5:00 PM (PT) (the “Public Voting Period”) with the exception of the “Adorably Adoptable” category which concludes October 21, 2024 at 5:00 PM (PT). Members of the public who are legal residents of and located in Canada and the fifty (50) United States of America or the District of Columbia, and who are at least eighteen (18) years old or the age of majority in their jurisdiction of residence, whichever is older (“Voters”), can cast votes on the Showcase page located at www.trickedout.trupanion.com. Voters may vote as many times as they like but may not vote for a particular Photo Entry more than once per twenty-four (24) hour period. Notwithstanding the foregoing, entrants to the Photo Contest will receive a unique link upon submission of their Photo Entry and if such entrants vote using this unique link, their votes will count as two (2) votes. Neither Sponsor nor any member of the Judging Panel will disclose the number of votes received by any Photo Entry.

Voters should vote for the Photo Entries across the following eight (8) categories (the “Photo Contest Categories”):

Pick of the Litter
  • Pet(s) must be aged ≤1 at the time of photo capture.
  • Appropriateness and comfort of the costume for a young pet.
  • Creativity and originality of the costume.
Kitty Corner
  • Photo must have a cat featured.
  • Appropriateness and comfort of the costume for a cat.
  • Creativity and originality of the costume.
Clinic Charmers
  • Photo must feature ≥1 pet(s).
  • Showcase the charm and appeal of the pet as a mascot.
  • Entrant must be a veterinary professional and identify their veterinary hospital during the submission process
  • Creativity and originality of the costume.
Adorably Adoptable
  • Photo must feature ≥1 pet(s) that are adoptable at the time of image capture.
  • Display the friendliness and approachability of the pet.
  • No costume required.
Me and My Human
  • Must feature a ≥1 pet and ≥1 person together.
  • Displays coordination and creativity of costumes among the pet and person.
  • Showcase the connection between the pets(s) and human(s).

When voting, Voters should vote based on the Photo Entry’s use of the Required Elements and following criteria (the “Voting Criteria”):

  1. Photographic Elements
    1. Composition: Balanced arrangement of elements in the frame (following principles like the rule of thirds).
    2. Lighting: Proper illumination that enhances the subject, creates mood, and avoids harsh shadows or overexposure.
    3. Focus: Clear and sharp focus on the subject, drawing attention to the key elements of the photo.
    4. Expression and Emotion: Capturing the subject’s emotion or expression, which adds depth and storytelling to the photo.
    5. Perspective and Angle: Unique angles or perspectives that provide a fresh viewpoint and add interest to the photograph.
    6. Color and Contrast: Effective use of color and contrast to make the subject stand out or to convey a particular mood.
    7. Framing: Use of natural or artificial frames within the photo to lead the viewer’s eye towards the subject.
    8. Clarity and Detail: High resolution and attention to detail, ensuring that the photo is visually appealing even when viewed up close.

SAFETY NOTICE: If the pet is in costume, all costumes must follow general safety guidelines (including but not limited to):

In addition to the public voting, a panel of judges consisting of five (5) representatives of Sponsor (the “Judging Panel”), will evaluate each Photo Entry and give 55% weighting to the Voting Criteria and 45% weighting to the Required Elements. The Photo Winners shall be determined as follows:

Entrants, Voters, and Photo Winners agree that the sole and final judgement as to all matters concerning the Campaign are at the sole discretion of Sponsor and its officers and staff.

VOTING AND WINNER SELECTION: On or about October 30, 2024, one Photo Winner for each Photo Contest Category will be announced via social posts on platforms including, but not limited to: Sponsor’s X feed (@trupanion), Instagram account (@trupanion), Facebook page (@trupanion), LinkedIn page (@Trupanion) as well as www.trickedout.trupanion.com Trupanion marketing materials, and corporate communications.

PRIZES: Each Photo Winner will receive (i) a custom pet portrait, (ii) Trupanion & Tricked Out for Treats SWAG, (iii) Trupanion “media spotlights” throughout 2024-2025 on a schedule determined by Sponsor, which may include (but is not limited to) placement in emails, web (e.g. trupanion.com, vet.trupanion.com, etc.), social media posts, etc. and (iii) a personalized digital media toolkit, which may include (but is not limited to) a winner’s badge, winner’s certificate, and social content. The value of the benefits to the Photo Winners does not exceed $100.

SWEEPSTAKES

PRIZES: Two (2) prizes will be awarded, each consisting of miscellaneous campaign-branded promotional items (Approximate Retail Value (ARV) $[100] each).

WINNER SELECTION AND CONFIRMATION: On or around October 30, 2024, one (1) winner from the United States and one (1) winner from Canada will be selected in a random drawing of all eligible entrants (each a “Winner”). If a Winner does not meet the criteria described in these Official Rules, he/she will be disqualified and will not receive a prize and another entrant may be selected. Before being declared a Winner, the applicable entrant may be required to sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (the “Winner Release”); and must comply with all other Sweepstakes rules, all in the sole discretion of Sponsor.

Winners will be notified within about four business days of being selected and will be contacted by email or social media handle provided at the time of entry into the Sweepstakes. Up to three attempts will be made to contact Winners within ten (10) business days following the draw. A Winner that does not or cannot accept a prize may be forfeited and a new Winner selected by random draw, in the Sponsor’s sole discretion will be awarded the relevant prize. A signed copy of the Winner Release must be received by the Sponsor no later than November 15, 2024. Sponsor is not responsible for the failure for any reason whatsoever of a Winner to receive notification or for the Sponsor to receive a Winner’s response.

Each Winner may be required to provide proof that he/she is the authorized account holder associated with a selected entry.

ODDS OF WINNING: The odds of winning depend on the number of eligible entries received.
